This case is nominated to this Court by Hon'ble The Chief Justice vide order dated 27.2.2025. 2. Heard learned counsel for the applicant, Sri Piyush Kumar Singh, learned A.G.A for the State of U.P. and perused the record. 3. The present bail application has been filed on behalf of the applicant in Case Crime No.733 of 2021, under Sections 409, 420, 467, 468, 471 & 120-B I.P.C., Police Station - Gomti Nagar, District - Lucknow, with the prayer to enlarge her on bail. 4. Learned counsel for the applicant has submitted that the applicant has been falsely implicated in the case for being brother of the Director of M/S Shine City Infraproject Pvt. Ltd. and he is in jail since 1.11.2021. He further submitted that applicant has been implicated in total 538 cases, out of which, in 30 cases he is enlarged on bail. It is also submitted charge sheet has already been filed against the applicant and in near future, there is no possibility of conclusion of trial. In these circumstances, the applicant is entitled for bail. In case of being enlarged on bail, he will not misuse the liberty of bail. 5. Learned A.G.A. has vehemently opposed the prayer for grant of bail and submitted that applicant is one of the Director of M/S Shine City Infraproject Pvt. Ltd. and he is real brother of the main accused, namely, Rashid Naseem, who has been declared as fugitive, therefore, he is not entitled for bail. 6. Considering the rival submissions of learned counsel for applicant, learned A.G.A., material available on record, contents of F.I.R., contents of master counter affidavit filed in the Criminal Misc. Bail Application No.10571 of 2024 as well as facts and circumstances of the case, it is evident that a huge amount of the citizens have been duped by M/S Shine City Infraproject Pvt. Ltd. and about 500 F.I.R.'s have been lodged against the applicant, therefore, I am of the view that the applicant is not entitled to be released on bail, accordingly, the present bail application is hereby, dismissed.
