1.PUBLIC PROSECUTOR The Court made the followin Order: This Criminal Petition under Sections 480 and 483 of BNSS, has been filed by the petitioners herein/Al and A2 seeking regular bail in crime No.24 of 2025 of Vizianagaram I Town Police Station, viz-lanagaram District, registered for the offences punishable under sections 20(b)(ii)(B) read with 8(C) of the Narcotic Drugs and psychotropic Substances Act,1985 (for short lthe NDPS Act'). 2. Case of the prosecution, in brief iS that On 29.01.2025, on receipt of credible information, +the Sub-Inspector along with his staff and mediators rushed to the Divisional Traffic Training School, East Coast Railway, situated at goods Shed, ViZianagaram.
On seeing the police party, five persons tried to escape from that place. On that, the police caught hold of them, and among the said persons, one CICL by name Vempadapu Manikanata also involved apart from other Persons Who are identified as Al to A4. On questioning, the CICL, disclosed his identity particulars and further confessed that Al and A2 are his classmates at school. During Sankranti festival himself, Al and A2 went to Araku, consumed liquor and ganja there, and they purchased five packets of c<3ff-, <* r-rty
\ ganja weighing about 2kg§ from unknown Person and after transporting the ganja, he kept the ganja in his house. Later, A2 informed to his friend A3 about the ganja, and On 29.01.2025, while himself, Al to A4 were d'lstributing the ganja at Railway Traffic Training School situated at Goods Shed, Vizianagaram, they Were Caught by POliCe. When questioned, Al to A4 also confessed the Said facts. The contraband along with other material was se'lzed under the cover of mediators report-
3. Learned counsel for the Petitioners contends that the Petitioners have been in judicial custody from 29.01.2025 and prays this Court to grant bail to the petitioners herein. 4. On the other hand, learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioners and submits that the petitioners herein have no previous criminal antecedents. 5. Heard. Perused the record. 6. Learned counsel for the Petitioners Submitted that the contraband alleged to be seized from the possession of accused is only 2Kgs of ganja, which is not of commercial quantity. lt is submitted that the petitioners had permanent abode and there is no possibility of their fleeing away from the justice. lt is submitted by the learned counsel for the petitioners that most of the witnesses are shown to be official w'ltnesses and the release of the accused would not cause hampering of investigation and tampering of witnesses. 7. ln v®lew Of the aforesaid facts and Circumstances Of the Case and since the contraband involved in the present Crime iS not a commercial quantity, this court is inclined to grant bail to the petitioners herein. 8.

On release, the petitioners shall appear before the statl'on House Officer concerned, once in a fortnight i.e., on lst and 15th of every month between 10.00 AM and 01.00 PM., for a period of three (3) months. iii. The petitioner shall make themselves aval®Iable for investigation as and when required and that they shall not cause any threat, I-nducement or proml'se to the prosecution witnesses.
