The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the order dated 10.09.2024 passed by Judicial Magistrate, Hathras, in Complaint Case No. 3948 of 2022, under Sections 323, 506 of I.P.C., whereby an application under Section 311 of Cr.P.C. has been allowed. Learned counsel for the applicant submits that the applicant is complainant and the application under Section 311 of Cr.P.C. was filed by the opposite party nos. 2 to 6/ accused persons to call for cross-examination on proposed questions. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
