THE HON’BLE SRI JUSTICE K. SREENIVASA REDDY Criminal Petition No.2901 of 2025 Order : This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner herein/A2, seeking anticipatory bail, in connection with Crime No.25 of 2025 of Sangam Police Station, Sri Potti Sriramulu Nellore district. 2. A case has been registered against the petitioner herein and another for the offence punishable under Section 308(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Case of the prosecution, in brief, is that on 03.02.2025, at about 08.00 hours, while the de facto complainant and his driver were proceeding to Nellore in his lorry bearing registration No.AP 39 UQ 1044 on NH-67 and when they reached Siddipuram village centre, A1 and A2 stopped the lorry, threatened the de facto complainant and his driver and extorted an amount of Rs.2,000/- from the de facto complainant forcibly and also made him to phone pay an amount of Rs.5000/- to the cell phone of A2. Further, they threatened the de facto 2 complainant and his driver with dire consequences, if they told the same to anybody. 4. A perusal of the material on record goes to show that this is a case of extortion and taking amount by threatening a person with common intention. Specific overt acts have been attributed against the petitioner herein/A2 that he, along with A1, stopped the lorry, threatened the de facto complainant and his driver with extortion and took an amount of Rs.2,000/- from the de facto complainant forcibly and also made him to phone pay an amount of Rs.5000/- to the cell phone of the petitioner herein/A2. Further, A1 and A2 threatened them with dire consequences. The offence alleged is grave in nature. Learned Assistant Public Prosecutor submitted that the investigation is at nascent stage and some more witnesses are to be examined. 5. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner herein/A2. 6. Accordingly, the Criminal Petition is dismissed. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed. _______________________ K.
