Petition has been filed challenging order dated 19th December, 2024 whereby directions have been issued for sealing/closure of the institution concerned. Learned counsel for opposite parties have raised a preliminary objection to the effect that petitioner's institution earlier was established in a different location and is currently being conducted from a separate location for which orders were earlier passed as indicated in the impugned order itself. It is submitted that however main orders passed earlier have not been challenged by petitioner and with the order dated 19th December, 2024 which is under challenge being only consequential in nature, the petition is not maintainable. In view of such objection being raised, learned counsel for petitioner upon instruction seeks liberty to withdraw this petition with liberty to file afresh. Considering such situation, the petition is dismissed as withdrawn with aforesaid liberty to file afresh.
