(2) Petitioner responded to an advertisement issued by Public Service Commission for the post of Assistant Statistical Officer. He participated in the written examination, however, at the time of documents verification, he was declared to be ineligible on the ground that the qualification possessed by the petitioner does not meet the requirement of the rules. Thus feeling aggrieved, petitioner has filed this writ petition seeking the following reliefs:
“i) Issue a writ, order or direction in the nature of Certiorari, quashing the
order dated 10.06.2025 (Annexure No. 1 to this Writ Petition) passed by Respondent No. 2 declaring the Petitioner ineligible.
ii) Issue a writ, order or direction in the nature of Mandamus, directing the Respondents to treat the Petitioner as eligible for the post of Assistant Statistical Officer in pursuance of the advertisement dated 07.02.2024 (Annexure No. 2 to this Writ Petition), and to consider his candidature for all further stages of the selection process.”
(3) Today, Mr. Ashish Joshi, learned Counsel appearing for the Public Service
2025:UHC:8745 Commission, makes a statement, on instructions, that the marks scored by the petitioner in the written examination are less than the cut-off marks fixed for the post of Assistant Statistical Officer in Statics and Economics Department and SMSE Department. Thus he submits that the relief as claimed by the petitioner do not survive.
(4) This Court finds substance in the submission made by Mr. Ashish Joshi. Since petitioner has not been able to secure sufficient marks for inclusion of his name in the select list, therefore, no useful purpose shall be served by keeping this writ petition pending. Accordingly, the writ petition is dismissed.
