This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest in connection with Dhanbad P.S. Case No.534 of 2024, for offences under Sections 126(2), 115(2), 118(1), 351, 352 and 3(5) of the Bharatiya Nyaya Sanhita. The case is presently pending before the Court of learned Chief Judicial Magistrate, Dhanbad. 3. Learned counsel representing the petitioners submits that the entire occurrence took place because the ally was blocked with the sacks of sand. He also submits that it is the informant who had trespassed the house of the petitioners and came to their house, as a result of which a scuffle had taken place and the mother of the petitioners has lodged the case against the informant. He submits that there was no intention to commit murder of any of the informant parties. 4. Learned A.P.P. representing the State and learned counsel representing the informant oppose the prayer for 2025:JHHC:15568 anticipatory bail and submit that there were grievous injuries inflicted by sharp cutting weapon, which is apparent from para-45 of the case diary. 5. Considering the submission and the fact that there was assault by these petitioners and there were several injuries on the victim, I am of the opinion that this is not a fit case to grant anticipatory bail to the petitioners. 6. Accordingly, this Anticipatory Bail Application stands dismissed. 7. If the petitioners appear before the Court concerned, their case will be considered without being prejudiced by the order of dismissal of this Court. (ANANDA SEN, J.) Prashant. Cp-3
