The record indicates that on 18.7.2016, a coordinate Bench of this Court had passed following order which reads as under:- "Notice on delay condonation application was issued by order dated 05.04.2016. As per office report dated 07.06.2016, learned counsel for the appellant has not taken steps. Learned Counsel for the appellant prays for and is granted two weeks' further time to take necessary steps. In case steps are not taken within two weeks from today the application shall stand dismissed. On taking steps office to proceed. " As per office report dated 29.03.2023 which indicates that steps have not taken in terms of the order dated 18.07.2016. Since, in light of order dated 18.07.2016 coupled with the fact that steps have not been taken the appeal stands dismissed in terms of earlier order. Since notices were issued on application filed under Section 5 of the Limitation Act which stand dismissed, consequently, the appeal also meets the same fate. Consigned to record.
