.... Petitioner(s).
Versus The State of Jharkhand
… Opp. Party(s).
------
CORAM :
SRI ANANDA SEN, J.
------ For the Petitioner(s) : Mr. A.K. Sahani, Advocate
Mr. Ajit Kumar, Advocate For the State : Mr. Satish Prasad, AddI. P.P.
…...... 05/ 20.06.2025: Heard, learned counsel for the petitioner and learned counsel for the State.
2. This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 272, 274, 275 and 292 of the Bhartiya Nyay Sanhita, 2003 read with Section 47(a)(f) of the Excise Act.
3. It is alleged that the petitioner is involved in an offence which relates to manufacturing of illicit liquor.
4.
Learned counsel for the petitioner submits that 45 liters of Mahuwa liquor was recovered from the house of Mukesh Chandrawanshi, but it has been wrongly mentioned that the petitioner was also there and he has fled. He submits that the said information is based on the secret information.
5.
Learned counsel for the State submits that petitioner fled from the place of occurrence and he is involved in making of illicit liquor along with Mukesh and others. He also submits that petitioner is also involved in the similar nature of case i.e. Telaiya P.S. Case No.112 of 2024, offence under Sections 270, 272, 273 and 290/34 of IPC and Sections 47(a)(f) of the Jharkhand Excise Act.
6.
Learned counsel for the petitioner in reply submits that the petitioner has been granted anticipatory bail in the aforesaid case.
7. Considering the nature of allegation and fact that there is one criminal antecedent of the petitioner of similar nature, I find that this is not a fit case for grant of anticipatory bail to the petitioner.
8. Thus, I am not inclined to entertain the anticipatory bail application. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Telaiya P.S. Case No.267 of 2024, pending in the Court of learned Additional Chief Judicial Magistrate, Koderma, stands rejected.
9. Petitioner should appear before the Court concerned, if he appears, this case will be considered on its own merit without being prejudice by the
order of this Court.
