The petitioner has challenged an alleged ex-parte order dated 18.01.2001 passed by Assistant Record Officer, Faizabad (now District - Ayodhya). However, the said order is not on record.
Learned Counsel for the petitioner invites our attention to khatauni at Page 45 wherein this order is mentioned. However, he says that in spite of having applied for a certified copy of the said order, the same has not been provided, as it is not traceable. Let the petitioner approach the Record Officer who shall get the
facts verified, and if such an order exists and there is no other legal impediment, he shall provide a certified copy of the order to the petitioner. If it does not exist, then he shall intimate the petitioner in writing, and simultaneously institute an enquiry as to how the order is not traceable, if it finds mention in the khatauni. Thereafter, the petitioner may avail remedies as may be prescribed in law. The writ petition is accordingly disposed of.
