The present contempt application has been filed pleading willful disobedience of the order dated 25.9.2024 passed by this Court in Writ-C No. 23893 of 2024. In pursuance to the previous order passed by this Court, the Standing Counsel has filed a compliance affidavit of the opposite party No. 1 disclosing that the premises of the applicant were not sealed by the opposite party No. 1, but by the Deputy District Magistrate and the opposite party No. 1 is not the competent authority to consider any plea of the applicant to remove the seal of the premises. The said compliance affidavit is taken on record. A perusal of the notice dated 18.10.2023 issued by the opposite party No. 1 also indicates that the premises of the applicant were sealed by the Deputy District Magistrate and not by the opposite party No. 1. On being confronted with the above, the counsel for the applicant prays that the present contempt application be dismissed as withdrawn to enable him to file modification/correction application for modification/correction of the order dated 25.9.2024 passed by this Court in Writ-C No. 23893 of 2024. In view of the prayer of the counsel for the applicant, the present contempt application is dismissed as withdrawn. Notices are discharged. Let the file be consigned to record.
