No.2961 of 2025 THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2961 OF 2025 ORDER: 1. Heard the learned counsel for the petitioner. 2. The petitioner was arraigned as A.1 in Crime No.7 of 2025 of Sri City Police Station, Tirupati District, registered for the alleged offences under Sections 329(3), 115(2), 351(2) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. The learned counsel for the petitioner submits that the petitioner, along with other accused, initially lodged a complaint against the 2ndrespondent. In retaliation, the 2ndrespondent filed the present complaint implicating the petitioner as accused. 4. The learned counsel further submits that the offences alleged against the petitioner are punishable below 7 years and therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 5. Considering the submissions of the learned counsel for the petitioners, the Station House Officer, Sri City Police Station, Tirupati District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar as the petitioner/A.1is -3- CRL.P. No.2961 of 2025 concerned, for the purpose of investigation in connection with Crime No.7 of 2025. 6. Accordingly, the criminal petition is disposed off. 7.
