The present petition has been filed with the following prayer : "(i) To quash and set-a-side the impugned order of rejection passed through CBR No.03 dated 17.02.2023 along-with all such letters of communications through which Building Plan submitted for House No.5, Baniya Bazar Cantt Lucknow is rejected. (ii) To declare as sanctioned and accord approval to the Building Plan submitted for House No.5, Baniya Bazar Cantt Lucknow of the appellants in the interest of and to secure the ends of Justice please." 3. The counsel for the petitioner states that in view of the statute under section 343 (3) of the Cantonment Act, any appeal preferred has to be decided within a period of ninety days and the appeal is said to be pending since long. 4. Considering the mandate of Section 343(3) of the Cantonment Act, the present petition is disposed off directing the appellate authority to decide the appeal preferred by the petitioner in accordance with law within a period of ninety days from today.
