The petitioner seeks bail in a case registered for offence under Sections 103(1) r/w 3(5) of the B.N.S., 2023. 3. As per F.I.R., this petitioner and co-accused Digambar Singh assaulted father-in-law of informant by means of Lathi & Danda, due to which, he died. 4. Learned counsel for the petitioner submits that informant is not eye-witness to the occurrence and only on the statement of Karan Kumar (informant’s Bhagina) and Guddu Kumar (informant’s brother-in-law), this petitioner and co- accused have been made accused in this case. Petitioner, having no criminal antecedent, is in custody since 01.05.2025. 5. Learned A.P.P. for the State vehemently opposes the Patna High Court CR. MISC. No.51545 of 2025(4) dt.07-11-2025 2/2 prayer for bail and submits that petitioner is named in the F.I.R. with specific allegation that he along with co-accused assaulted the deceased with lathi. During course of investigation also, number of witnesses have supported the prosecution case. 6.
