Present petition has been filed with the following prayer: "(i) Issue an appropriate writ, order or direction in the nature of mandamus declaring the recommendation letter no.1391 dated 3.1.2024 (mentioned in letter) by means of which the matter sent by opp. party no.5 i.e. Block Development Officer, Block-Mangraura, Tehsi- Patti, Pratapgarh by resolution dated 31.12.2024 of the Gram Sabha for appointment of fair price shop agent of the Gram Sabha Koni, Tehsil- Patti, District Pratapgarh to the opp. party no.4, i.e. Sub-Divisional Officer, Tehsil-Patti, Pratapgarh who place the same before the Tehsil level Committee as illegal, null, void and arbitrary, in the interest of justice, which is contained as annexure no.3 to this writ petition, in the interest of justice. (ii) Issue a writ, order or direction in the nature of Mandamus commanding and directing the opposite parties specifically 2 to 5 to consider the objection raised by the petitioner through representation dated 1.1.2025 should be decided by the Tehsil level committee Tehsil- Patti, District Pratapgarh and conduct further a fresh selection process of the Fair Price Shop Agent in open general meeting, of the Village Panchayat Koni, Block-Mangraura, Tehsil Patti, District Pratapgarh, which is contained as annexure No. 1 to this writ petition, in the interest of justice." 2. Considering the fact that the tehsil level committee is to decide finally and the petitioner has raised a grievance, the present petition is disposed off with direction that the tehsil level committee shall take into consideration the grievance raised by the petitioner prior to taking final decision.
