Mr. Lalit Sharma, learned counsel for the applicant. 2. Mr. V.S. Pal, learned A.G.A. with Mr. Himanshu Sain, learned Brief Holder for the State. 3. The present applicant ‘Sarik Khan’ S/o Tahir Khan is praying for bail in relation to First Information Report dated 20.12.2024 bearing FIR No. 620 of 2024 P.S. Rudrapur, District Udham Singh Nagar, wherein, the present applicant along with one Mohd. Saheem were implicated for the offence punishable under Section 318 (4) of BNS, 2023. 4. This is the second bail application and the first bail application was rejected on 21.03.2025. 5. Learned counsel for the applicant submits that in total three persons were chargesheeted including applicant. He submits that the first bail application was rejected on 25.03.2025 and thereafter two other co-accused persons have been granted bail one by this court on 11.09.2025 and the other co-accused granted bail by the Trial Court on 17.05.2024. He submits that the present applicant is languishing in jail since 23.12.2024 and all the offences are triable by Magistrate and, therefore, taking into consideration that the other co-accused have been granted bail, the applicant be released on bail. 6. On the other side, Mr. V.S. Pal, learned A.G.A. have not disputed that the other two co- accused namely Naeem and Mohd. Saheem have been granted bail and the present applicant is languishing in jail since 23.12.2024 and have also not disputed that all the offences are triable by Magistrate. 7. After hearing the arguments of learned counsel for the parties and taking into consideration that the other co-accused have been enlarged on bail and the present applicant is languishing in jail since 23.12.2024, therefore, this 2025:UHC:9173 court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘Sarik Khan’ be released on bail on furnishing the personal bond and two reliable sureties each of the like amount to the satisfaction of the court concerned. 10. It is made clear that after being released on bail the applicant shall report to the nearest police station on the first day of every month and will also provide his mobile number, failing which the prosecution is free to move an application for cancelling the bail.
