Neutral Citation No. - 2025:AHC-LKO:4292-DB Court No. - 2 Case :- WRIT - C No. - 261 of 2025 Petitioner :- Vinod Kumar Singh Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Lko. And 4 Others Counsel for Petitioner :- Ajay Kumar Pandey Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Rajan Roy,J. Hon'ble Manish Kumar,J. 1. Heard. 2. It is undisputed that the lease period of the petitioner came to an end on 09.01.2024. 3. Now, this petition has been filed saying that roe have been put in the pond, therefore, 15 days' time may be granted to the petitioner to take out the fish from the pond. 4. The contention of learned standing counsel is that fresh auction has already been held and there is no provision for granting such relief to the petitioner. 5. Whether the roe had been put in the pond by the petitioner or not is a factual issue which cannot be decided under Article 226 of the Constitution of India. The fishery rights have already been settled in favour of opposite party no. 5, as informed by the standing counsel. 6. No case is made out for interference. The writ petition is dismissed, however, with liberty to the petitioner to pursue other remedies as may be prescribed in law.
