RAGHUNANDAN RAO DATE : 20th March 2025 PC : The present Writ Appeal has been preferred against interim orders dated 04.03.2025 as also 05.03.2025 passed in W.P.No.5435 of 2025. By virtue of the order dated 04.03.2025, the learned single Judge had directed the respondents to accept the tender document of the petitioners since it was within the last date prescribed for acceptance thereof. The On 05.03.2025, the 2. direction also was to process the tender document. interim order was ordered to be continued till the next date of hearing. Learned counsel for the appellants states that the purport of the extension of the interim order is that even when the petitioners do not fulfill the requirement of the turnover, which is fixed at Rs.10 crores, yet, by virtue of the 3. 2 order impugned, the appellants would be handicapped in rejecting the bid of the petitioners during the technical evaluation. 4. We, however, are of the opinion that the manner in which the appellants are interpreting the interim orders dated 04.03.2025 and 05.03.2025 is not what perhaps it purports to be. In fact, processing the application of the petitioners, does not, in any way, suggest that the bid cannot be rejected if it otherwise does not qualify the technical standards which have been prescribed including the condition regarding the turnover. 5. Be that as it may, we clarify that while the appellants are entitled to process the bid of the petitioners, nothing would prevent them from rejecting the same in case it does not meet the technical qualifications prescribed. This would be without prejudice to the petitioners’ case succeeding on the issue of mala fides/bias or on the ground that it is tailor made to suit a particular bidder. 6.
