The Regional Manager (Operation), Dehradun passed an order on 21.07.2025, informing the petitioner that a sum of `2,69,710/- has to be recovered from the petitioner and after adjusting the said amount, a sum of `11,89,675/- would be paid to him as gratuity. 4. Learned counsel for the petitioner contends that the order passed by Regional Manager (Operation) is unjust and unsustainable, petitioner was not liable to pay any amount to the Corporation and the order of recovery, that too after petitioner’s retirement, is illegal. He also relies upon a judgment rendered by Division Bench of this Court in Special Appeal No. 245 of 2022. He submits that present writ petition may be decided in terms of the said judgment passed by Division Bench. 5. Mr. N.S. Pundir, learned counsel appearing for the Corporation concedes that question involved in that appeal is identical to the one involved in this writ petition. 6. In such view of the matter, the writ petition is decided in terms of the judgment dated 04.04.2024, rendered in Special Appeal No. 245 of 2022.
