Purkayastha, learned counsel for the petitioners. 2. The grievance of the petitioners, as raised in this writ petition is to the effect that the petitioners have preferred an appeal before the District Commissioner, Morigaon against the Page No.# 3/3 order dated 17.01.2025 passed by the Circle officer, Bhuragaon Revenue Circle, Bhuragaon which was numbered as petition No.033/025 dated 27.01.2025, and the same is still pending as no action has been taken. 3. It is also the contention of the learned counsel for the petitioner that in the said petition (Annexure-C), instead of taking the appeal for hearing, the appellate authority again forwarded the said appeal to the Circle Officer for necessary action as per law. 4. In the aforesaid backdrop, this court sought instructions from the State counsel and in the meantime, the learned state counsel submits that an appeal has been registered and notice has been issued under letter No.MRK.2/2025/39, fixing the date to be 23.05.2025 at 11.00 AM, in the office of the District Commissioner, Morigaon. 5. It is submitted by Mr. Purkayastha, learned counsel for the petitioner that in view of such notice, the petitioner has already entered appearance on 23.05.2025. 6. In view of the aforesaid, nothing survives to be decided in this writ petition. Accordingly, same stands closed. 7. The instruction given to Mr. D Nath, learned senior Government Advocate by the Addl. District Commissioner (Rev), Morigaon is kept on record. JUDGE Comparing Assistant
