[2025:RJ-JP:35869] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 3798/2025 Rajaram S/o Harisingh, Aged About 23 Years, R/o Ghoghadi Police Station Dangipura District Jhalawar. At Present In Sub Jail, Aklera. ----Accused-Petitioner Versus State Of Rajasthan, Through The PP ----Respondent For Petitioner(s) : Mr. Harendra Singh, Adv. For Respondent(s) : Mr. Tapesh Agarwal, PP with Mr. Gaurav Gupta, Asstt.G.A., Mr. Shubham Kumar Sain, AAAG HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 08/09/2025 1. The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.74/2024 registered at Police Station Dangipura, District Jhalalawar for the offences punishable under Sections 341 and 302 of IPC. After completion of investigation, police filed charge-sheet in this matter for the offence punishable under Section 302 of IPC. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. He submits that call details collected by the Investigating Agency would reveal that petitioner was not present at the place of incident and some unknown persons committed crime in which wife of the petitioner died. It is contended that trial will take [2025:RJ-JP:35869] (2 of 2) [CRLMB-3798/2025] considerable time in its conclusion. Counsel submits that petitioner is in custody since 06.03.2025 and further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor opposes the submissions made by learned counsel for the petitioner. He submits that there is allegation against the petitioner of committing murder of his wife. He submits that admittedly, matter was not reported to the police by the petitioner and dead body of the deceased was found in the house of the petitioner. Counsel further submits that blood stained stick, axe and clothes have been recovered at the instance of the petitioner. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the parties, especially considering the fact that deceased died in the house of the petitioner, so also the fact that murder weapon and blood stained clothes have been recovered at the instance of the petitioner, as also looking to the nature and gravity of offence, but without commenting anything on the merits/demerits of the case, this court is not inclined to enlarge the petitioner on bail. 6. Accordingly, this bail application stands dismissed. 7. The observations made hereinabove are only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J MADAN/49
