Order on Board 26.03.2025
1. The present contempt petition has been filed by the petitioner alleging non-compliance of order of this Court dated 10.02.2023 passed in WPS No. 4266 of 2012. Vide order dated 10.02.2023 this Court has passed the following
order/direction:-
“10.Having regard to the facts and circumstances of the case and the
2 principles of law laid down by the Hon’ble Supreme Court in the subject matter, the petition is allowed and the impugned order dated 03.09.2012 (Annexure P/1, P/2 and P/3) are hereby set aside. The respondent authorities are directed to again inspect the matter and records of 1997 till 28.08.2008 with back wages. It is also directed that all this exercise be completed within a period of 60 days from the date of receipt of copy of this order.”
2.
Learned counsel for the petitioner submits that in compliance of
order/direction of this court, respondent no. 2 has regularized the petitioner in the service and has also paid the back wages, but there is a calculation mistake in the back wages. He further contended that respondent no. 2 has not provided any calculation chart to the petitioner. Hence order/direction of this court has not been duly complied with.
3.
Learned counsel for the respondent submits that as per order/direction of this court, respondent/contemnor has regularized the petitioner in the service and also paid all the back wages to him, therefore, this contempt petition at this stage is not maintainable.
4. In view of the above submission, this contempt petition is disposed of directing the concerned respondent authority to provide the calculation chart of the back wages to the petitioner, within a period of ‘15 days’ from today. If petitioner is dissatisfied/aggrieved with the calculation part of the back wages, he will be at liberty to assail the same by way of fresh proceeding.
5. Subsequently, with the aforesaid direction, the present contempt petition is disposed of.
