The present application under Section 482 Cr.P.C., has been filed to quash the Summoning Order dated-01.12.2023 passed by Learned Civil Judge (J.D). F.T.C(Case of offence against Women) Bahraich, in Case No.23694 of 2023 U/S 323,504,354 I.P.C against applicant No. 1 and 2 and U/S-323,504 against applicant No. 3, Police Station-Payagpur, District- Bahraich, as well as entire proceeding of complaint case no 23694 of 2023 Smt Fatma Vs Shiv Nath @ Raj Kumar And others, Police Station-Payagpur, District Bahraich. After arguing for sometime, learned counsel for the petitioners submits that he does not want to press this application with liberty to move an application for discharge through counsel before the trial court and the same may be decided by the learned trial court in a time bound manner. Accordingly, the petition is dismissed as not pressed providing that in case, the petitioners move an appropriate application for discharge through counsel before the concerned Court below within a period of fifteen days from today, the same shall be considered and decided expeditiously, preferably within a period of two months in accordance with law, by the concerned trial court.
