PUBLIC PROSECUTOR The Court made the following: ORDER:I This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner/accused, seeking regular bail, in Crime No.70 of 2025 of Razole Police Station, Dr.B.R.Ambedkar Konaseema District. 2. A case has been registered against the Petitioner herein for the offences punishable under Section 109(1 ) BNS 3. The brief facts Of the Case are that the defaCtO complainant is employed with M/s, Sudhakara lnfratech Private -I -I / .trsEJap-- I 2 LI'mited as a Squad member. His duty was to check the waybills for vehl'cles transportI'ng minerals (such as road metal, etc.). on o3.03.2025, at around 8.-30 p.m., the defacto complainant, along with his colleagues, was on duty at the DI'ndi Check Post. The driver of a 10-tire lorry bearing No. AP-39-V-5232, transporting road metal (mineral), did not stop hl's vehI'Cle at the check post and proceeded towards sivakodu in a rash and negligent manner. The defacto complainant and his staff chased the vehicle in their Bolero vehicle, bearing No. AP-39-V-5252, and stopped I-I at the Sivakodu petrol Bunk Bus Stop in Sivakodu village. The accused then abused them in filthy language and, with the intention of causing harm, attempted to collide with the Bolero vehicle. Afterward, the accused unloaded the minerals (metal) and fled the scene. consequently, the police registered a Case against the accused. 4. Heard. perusedtherecord. 5. The learned counsel for the petitioner/accused submits that the petitioner was remanded to judicial custody on 12.03.2025 and has been Ion judicI'al Custody Since then. Most of the investigation has been completed. The learned counsel further submitted that the Lorry Owners Association, Dr. B.R. ffl! I \ .i \ ,7i 3 Ambedkar Konaseema7® District, had submitted a representation against M/s. Sudhakara lnfratech Private Limited regarding the establishment of a checkpost on the highway. This letter was forvarded to the Commissioner & Director of Mines and Geology, Ibrahimpatnam, on ll.09.2024, requesting further necessary action. The learned counsel for the petitioner contends that the defacto complainant's company holds a grudge against the Lorry Owners Association due to the submission of this representation, and as a result, a false case has been filed against the petitioner. In support of this contention, the learned counsel has submitted two material documents. The learned Assistant Public Prosecutor submits that the investigation has been completed and the charge sheet has been filed. Considering the same, this Court finds that further detention of the petitioner is not required, and the completion of the investigation indicates that the release Of the petitioner/accused would not hinder the investigation. Therefore, this Court is inclined to grant bail to the petitioner/accused, subject to the following conditions: (i) The petitioner/accused shall be released on executing a personal bond for Rs.10,000/- (Rupees ten thousand only) I --| 4 with one surety for a like sum to the satisfaction of the learned Judicial First Class Magistrate, Razole. (ill) That the petitioner is directed not to hamper the I'nVeStigatiOn and tamper with the prosecution witnesses and he shall cooperate with the investigation. 6.
