Neutral Citation No. - 2025:AHC-LKO:3630-DB Court No. - 2 Case :- WRIT - C No. - 329 of 2025 Petitioner :- Anjani Kumar Singh Respondent :- State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Revenue Lko. And 5 Others Counsel for Petitioner :- Satyendra Kumar Tiwari,Jay Prakash Singh Counsel for Respondent :- C.S.C.,Virendra Mishra Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J. Heard. The petitioner is aggrieved by the entries in the revenue record in favour of the Nagar Palika Parishad, Sultanpur, based on an order passed by the Tehsildar on 22.06.2005. He seeks a writ of Certiorari for quashing the forged entry. Learned Counsel for the petitioner relied upon a judgment and decree dated 23.12.1943 by the Munsif, Sultanpur in regular suit no. 160 of 1942, Raja Bhagwan Bux Singh Vs. Raja Jagdish Pratap Shahi & others. The said suit was filed by the predecessor in interest of the petitioner, as claimed by him, and the suit was decreed in their favour and a decree of declaration and possession of the property in suit was granted. However, the grievance is that in spite of it, the order dated 22.06.2005 was passed by the Tehsildar. The aforesaid order dated 22.06.2005 was amenable to appeal / revision, as the case may be, under the relevant statutes applicable at the time. Even otherwise, if any correction in the revenue records is sought based on some forgery or fraudulent act, the remedy would lie under the U.P. Revenue Code, 2006 or the earlier enactments as the case may be. A writ petition directly under Article 226 of the Constitution of India is not maintainable. We dispose of this petition without interfering in the matter but with liberty to the petitioner to avail remedies, as may be prescribed in law.
