By this petition, petitioner herein has challenged the order No. DIVCOM- “K”/08/2025 dated 22.01.2025, passed by the Divisional Commissioner, Kashmir, whereby, the detenue namely Sajad Ahmad Lone @ Saj Pal S/O Gh. Mohd Lone R/O Lastiyal, Kalaroos, District Kupwara, has been detained under the provisions of Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances Act, 1988. It is stated by learned counsel for the respondents that the said order was executed on 06.02.2025 and the instant petition has rendered infructuous. 2. Perusal of the reply reveals that the period of detention as prescribed in the order of detention was for a period of one year, which has expired on 05.02.2026. 3. In view of the above, the order of detention has outlived its life and the detenue, in consequence thereof, is entitled to be released from the custody. 4. Accordingly, while holding the petition as having become infructuous, it is ordered that the detenue namely Sajad Ahmad Lone @ Saj Pal S/O Gh. Mohd Lone R/O Lastiyal, Kalaroos, District Kupwara, be released from detention forthwith, if not required in any other case. 5. Disposed of.
