Heard learned counsel for the petitioner and learned A.G.A. for the State as well as perused the record. The instant Writ Petition has been filed seeking following main relief:- "(i) Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties particularly opposite party no.3 to ensure the proceeding U/s 145 Cr.P.C. against the opposite party no.5 and 6 in respect of police report dated 18.02.2021 (contained at Annexure No.1 to this writ petition). After arguing at some length, learned counsel for the petitioner submits that he wants to withdraw this writ petition with liberty to approach the Civil Court for appropriate orders in the suit, which is already pending between the parties.
