HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE
ORDER 19.11.2025
1. Impugned in this appeal filed by the appellant under Section 21(4) of the NIA Act, 2008, is an order dated 13th August, 2025 passed by the learned Session Judge, Kupwara, in case FIR No. 363/2020 under Section 7/25 Arms Act and Sections 16, 20, 23, 39 of UA(P) Act, whereby the Bail Application filed by the appellant herein has been rejected.
2.
Learned counsel appearing for the appellant would fairly submit that the prosecution has examined almost all the witnesses and the trial is now near completion and, therefore, pray that in case this Appeal is
disposed of with a direction to the Court below i.e., the Court of Additional Sessions Judge, Kupwara (Special Judge under NIA Act), to conclude the trial within a reasonable time, he would not press this appeal.
3. Having considered the submissions made by the learned counsel for the appellant and also taking note of the fact that the trial is near completion, it would not be appropriate to show indulgence at this stage. Accordingly, this appeal is disposed of without interfering with the order impugned but with a request to the learned Court below to wrap up the trial within a period of two months and make an endeavor to pronounce the judgment by 31st January, 2026.
4. It is also provided that in case for the reasons beyond the control of the Trial Court it is not possible to conclude the trial by the date fixed, the Trial Court shall be at liberty to seek extension from this Court.
