By the present writ petition, the petitioner is seeking a direction towards the respondent authority to conclude the mutation proceedings in respect of the ancestral land of the petitioners within a stipulated period. 2. Learned counsel for the petitioner would submit that the father of the petitioner is having the agricultural land bearing Khasra No. 381 area about 0.44 hectare land situated at Village- Kuruskera P.H. No. 14 present P.H. No. 32 Tahsil- Rajim District- Gariyaband (C.G.), he died on 22.05.2023, thereafter, the petitioners, who are the legal heirs of the deceased moved an application under Section 109, 110 of CG Land Revenue Code 1959, before the respondent no. 3 and requested for mutation of their name in the concerned Revenue 3 Records. Despite, the said fact till date no action has been taken by the authorities. The petitioners are running from pillar to post for redressal of their grievance, but the same does not fructify. 3. On the other hand, learned counsel for the State on instruction would submit that if the application is pending consideration before the respondent SDO/Tehsildar, the same shall be considered and decided within a stipulated period. 4. I have both the counsels for the parties and perused the documents. 5. It is not in dispute that the petitioners moved an application on 06.02.2024 before the respondent no. 3 and prayed for mutation of their name in respect of the lands owned by their late father. Thereafter, the petitioner approached the respondent no. 2 SDO also but till date no initiative has been taken by the said authority for the reasons best known to them. 6. Having considered the entire facts and circumstances of the case, interest of justice would be sub served, if the direction is given to the respondent authority to consider and decide the pending application of the petitioner. Accordingly respondent nos. 2 & 3 are directed to consider the pending application of the petitioner within a period of 45 days from the date of receipt of the order. 7.
