Neutral Citation No. - 2025:AHC-LKO:2257 Court No. - 16 Case :- CRIMINAL REVISION DEFECTIVE No. - 12 of 2025 Revisionist :- Ankush Singh @ Lalu Opposite Party :- State Of U.P. Thru. Prin. Secy. Home Lko. And 2 Others Counsel for Revisionist :- Iqbal Ali Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. (I.A. No. 2 of 2024 - Application for Condonation delay) Heard learned counsel for the revisionist and learned AGA for the State. On due consideration to the averments made in the affidavit filed in support of the application for condonation of delay, the application for condonation of delay is allowed. The delay of 27 days in filing the appeal is hereby condoned. (Order on revision) Heard learned counsel for the revisionist and learned AGA for the State. Notices to respondent no. 2 and 3 are dispensed with in view of the proposed order. Under challenge is the impugned order dated 30.08.2024 whereby the learned trial court awarded the maintenance of Rs. 2500/- as well as Rs. 1500/- per month to respondent no. 2 and 3 respectively (total amount of Rs. 4000/- per month). Perused the record. Perusal of the record shows that it is not in dispute that respondent no. 2 is legally wedded wife and respondent no. 3 is minor daughter of the revisionist. They are residing away from
the revisionist with sufficient cause. Respondent no. 2 was subjected to cruelty due to demand of dowry. The revisionist has adequate source of income as discussed in para 15 of the judgment under challenge. He has neglected to maintain his wife and minor children. Respondent no. 2 appears to be destitute. I find no illegality in the order impugned. The revision being devoid of merits is dismissed. Order Date :- 13.1.2025 R.C.
