JUSTICE SOUMITRA SAIKIA ORDER 30.05.2025 Heard Mr. R Dubey, learned counsel for the petitioner. Also heard Mr. B. Gogoi, learned Addl. Advocate General, Assam. This contempt petition has been filed alleging willful disobedience of the directions contained in the order dated 08.04.2019 passed in W.P(C) No. 1920/2019. The writ petition was disposed with the directions contained in the order. However, the same were not carried out, the contempt petition has been filed. Today when the matter is called up, Mr. Gogoi has submitted before the Court that the directions contained in the order dated 08.04.2019 stood carried out on 10.08.2023 itself. However, because of miscommunication between the respondents and the counsel, this order could not be communicated. The order reads as under: “GOVERNMENT OF ASSAM MEDICAL EDUCATION & RESEARCH DEPARTMENT DISPUR :::: GUWAHATI-781006 ORDERS BY THE GOVERNOR NOTIFICATION Dated Dispur, the 10th August, 2023 No. HLB.480/2018/393: Pending disposal of Disciplinary Proceeding, the notification of suspension issued vide No. HLB.480/208/50 dated 25.10.2018 read with corrigendum No. HLB 480/2018/57 dated 26/10/2018 in respect of Dr. Anindya Sundar Baishya, the then Associated Professor, Department of Surgery (now retired), Silchar Medical College & Hospital and the then Superintendent (i/c), Silchhar Medical College Hospital is hereby revoked. This issues in pursuance of Hon’ble High Court order dated 08.04.2019 in WP(C) No. 1920/2019 Sd/- Dr. Siddharth Singh, IAS Commissioner & Secretary to the Govt. of Assam, Medical Education & Research Department” The submissions made by the learned counsel for the respondent is not disputed by the learned counsel for the petitioner. In that view of the matter, since the order stands complied with, this Court does not wish to proceed any further in the contempt petition. Accordingly, the contempt petition stands closed.
