1. Heard Shri Vijay Kumar, Advocate holding brief of Shri D.K. Tripathi, learned counsel for the petitioner and learned Counsel for the respondents.
2. This writ petition has been filed for the following main prayers :
"(i). issue a writ, order or direction in the nature of mandamus commanding the opposite parties to regularise the services of the petitioner on the post of work supervisor the post on which he is working since 01.04.1988 continuously, and pay him salary for the said post every month as and when the same falls due on the basis of revised pay scale. 3. This Court had passed the interim order on 27.10.2005 which is quoted as under :
"Heard Shri D.K. Tripathi, learned counsel for the petitioner and Sri Shishir Jain who has accepted notice on behalf of opposite parties. Let counter affidavit be filed by opposite parties within four weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter. List this petition alongwith Writ Petition Nos.626 (S/S) of 2005 and 4995 (S/S) of 2005 and other connected matters in January, 2006 for admission/hearing.
Learned counsel for the petitioner has submitted that the petitioner was appointed as Helper in the services of U.P. State Bridge Corporation Ltd., in the year 1985 but he has been working as Work Supervisor since 1988. The grievance of the petitioner is that he has not been considered for regularisation on either of the posts, neither as Helper nor as Work Supervisor. He has completed more than 17 years of service in the
Corporation and he is still stagnant as a Group-II employee. In view of above, the opposite parties are directed to consider the case of the petitioner for regularisation on the post he has worked for more than ten years. If the work of Work Supervisor is being taken from the petitioner, he may be allowed allowances admissible to a Work Supervisor in the Corporation."
4. It has been informed by learned counsel for the petitioner that in pursuance of the order dated 27.10.2005 passed by this Court, the petitioner has been regularized.
5. Learned counsel for respondents also does not dispute the said fact.
6. As the prayer made in the writ petition has already been allowed by the Department itself, no cause of action survives.
7. The writ petition is disposed of.
