Neutral Citation No. - 2025:AHC-LKO:2949-DB Court No. - 2 Case :- WRIT - C No. - 316 of 2025 Petitioner :- Baijnath And 4 Others Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Lko. And 4 Others Counsel for Petitioner :- Fateh Bahadur Singh,Veer Keshwar Singh Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Rajan Roy,J. Hon'ble Brij Raj Singh,J.
1. Heard.
2. The grievance of the petitioners is that chak marg is in the process of being constructed on their land bearing Gata No. 10 on which their grove is existing.
3. Learned standing counsel has instructions to the effect that the chak marg has been constructed on Gata No. 29 and prior to it demarcation was undertaken and the chak marg has been constructed on the land where a path already existed.
4. In view of the above, petitioners should get the boundaries of their Gata bearing No. 10, as claimed, demarcated under Section 24 of the U.P. Revenue Code, 2006 and once the said exercise is completed then the factual position would be clear as to whether the chak marg has been constructed on the grove land of the petitioners or it is otherwise. If it is on the grove land of the petitioners then they can seek further relief against the concerned parties or they may themselves take remedial measures, as the case may be.
5. The petition is disposed of. [Brij Raj Singh, J.] [Rajan Roy, J.] Order Date :- 17.1.2025 Santosh/- Digitally signed by :- SANTOSH KUMAR High Court of Judicature at Allahabad, Lucknow Bench
