Borthakur, learned Additional Public Prosecutor for the State of Assam. 2) This application has been filed under Section 482 BNSS, 2023 praying for pre- arrest bail in respect of PRC Case No. 486/2024 pending in the Court of the learned Judicial Magistrate Page No.# 2/2 First Class, Kaliabor, Nagaon. 3) The petitioner Md. Romij Uddin has been shown as an absconder in the charge sheet alleging commencement of sessions triable offence. 4) The petitioner submitted that if he appears before the Court below, he will be remanded to custody because this Court does not have the jurisdiction to entertain the bail application. 5) According to the petitioner, he has been unnecessarily arrayed in this case and therefore, he deserves to be given some opportunity to defend himself in the trial. 6) I have considered the submissions made by the learned counsels of both the sides. 7) This Court is of the opinion that the petitioner deserves to given adequate opportunity to contest the case before the Trial Court. Therefore, this application is allowed. 8) It is hereby directed that within the next 10 days from today, the petitioner Md. Romij Uddin shall appear before the Court of the learned Judicial Magistrate First Class, Kaliabor, Nagaon in respect of PRC Case No. 486/2024. 9) On his appearance, the petitioner shall be released on bail of Rs. 25,000/-, with a surety of the like amount, to the satisfaction of the learned Judicial Magistrate First Class, Kaliabor, Nagaon. 10) With the aforesaid direction, this anticipatory bail application stands disposed of.
