1. Through the medium of instant application, the petitioner herein seeks disposal of the main petition being CRM(M) No.41/2025 wherein the petitioner claims to have challenged the complaint filed by the respondent/non-applicant herein under Section 12 of the Protection of Women from Domestic Violence Act 2005, pending before the court of City Magistrate, Srinagar, besides seeking setting aside of orders dated 04.05.2024 and 19.12.2024 passed by the court of Additional Sessions Judge, Srinagar, in Revision Petition rising out of the said proceedings filed under Section 12 supra.
2. According to counsel for the petitioner, the aforesaid revision proceedings before the Additional Sessions Judge, Srinagar, stands
disposed of, whereas, the main complaint is pending adjudication before the court of City Magistrate, Srinagar, proceedings wherein, however, are not being expeditiously undertaken by the said Magistrate.
3. It is also stated that the rental accommodations stands provided to the respondent herein as per the order of the Magistrate, who, however, denied putting up therein.
4. It is further stated that as per the report of the Protection Officer (Child Project Officer Poshan Srinagar) no domestic violence has ever
taken place against the respondent herein and the documentary proof to that extent has been annexed with the petition forming as Annexure-IV.
5. The learned counsel for the petitioner, thus, under these circumstances through the medium of instant application, would seek the disposal of the main petition being CRM(M) No. 41/2025 by an innocuous direction for directing the court of City Magistrate, Srinagar, to conduct the proceedings in the main complaint expeditiously and make an endeavour to dispose of the same without any delay.
6. In view of the aforesaid innocuous prayer made by the counsel by the petitioner-applicant the record of the main petition has been called and perused by the Court.
7. Having regard to the aforesaid submissions of the counsel for the petitioner, the main petition is taken up for final disposal and is disposed by requiring the City Magistrate, Srinagar, to undertake the proceedings in the complaint filed by the respondent herein against by the petitioner herein expeditiously and dispose of the same preferably within a period of two months from today.
8. The Registry shall send a copy of this order to the court below for compliance.
