Order 23/04/2025
1. The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.0026/2025 registered at Police Station-Gudha, District-Jhunjhunu for the offences under Sections
[2025:RJ-JP:17083] (2 of 3) [CRLMB-3842/2025] 189(2), 331(6), 109(1), 351(3), 352 of BNS and Sections 3, 27 of the Arms Act.
2. Since both the bail applications arise out of common FIR, therefore these cases are decided by a single order.
3. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
4.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. He further submits that the act of firing was not mentioned in the FIR. Both the petitioners are of tender age. In the event of their regular detention, their future prospects will be significantly prejudiced. The co-accused-Praveen Kumar, Naresh Kumar and Ankit Kumar have been enlarged on bail by the trial court. Charge sheet has been filed. The petitioners-Himanshu Man and Lokesh @ Lucky are behind the Bar since 21.01.2025 while the accused-petitioners- Sunil Khatana and Hemant Man are behind the Bar since
23.01.2025. The trial of the case may take considerable time, hence the bail applications of the petitioners may be allowed.
5. Learned Public Prosecutor has vehemently opposed the bail applications.
6. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners.
[2025:RJ-JP:17083] (3 of 3) [CRLMB-3842/2025]
