Respondent(s) Through: Coram: HON’BLE THE CHIEF JUSTICE HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE ORDER 25.11.2025 1. This is an application seeking condonation of delay of 271 days in filing the appeal against judgment dated 24.12.2024 passed by the learned Writ Court in WP(Crl) No. 175/2023, titled, Gowhar Mohi Ud Din Dar vs. U. T. of J&K and others, whereby the order of detention dated 19.04.2023 issued by applicant No. 2 herein was quashed. 2. The maximum period for which the detenue can be detained, in the interest of security of the Union Territory/State under the Public Safety Act, is two years. Two years have already lapsed in April, 2025.In fact, the appeal itself has been rendered infructuous due to expiry of the period of detention in terms of order dated 19.04.2023. 3. In the application seeking condonation of delay, the applicants have stated that sanction to file appeal was granted on 21.01.2025, and some 12 CM No. 7736/2025 Page 2 of 2 time was consumed for completing the formalities to file the appeal. This appeal has been filed only on 20.11.2025 i.e. after nearly 10 months of grant of sanction and a perusal of the application seeking condonation of delay reveals that the applicants have demonstrated no cause, let alone a sufficient cause, to warrant the condonation. 4. Thus, the instant application seeking condonation of delay is dismissed. As a consequence, the accompanying appeal (LPA No. 277/2025) also stands dismissed.
