62 Regular IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR TrP (C) 18/2025 Nazir Ahmad Khanday. ….. Petitioner (s) Through: Mr. Shabir Ahmad Dar, Adv. V/s Burzoo Ahmad Bhat. ….. Respondent(s) Through: None. Coram: Hon’ble Mr. Justice Sanjay Dhar, Judge ORDER 18.11.2025 Through the medium of present petition, the petitioner is seeking transfer of Execution Petition titled “Nazir Ahmad Khanday vs. Burzoo Ahmad Bhat” from the court of Additional District Judge, Budgam to the court of Principal District Judge, Budgam. It seems that the grievance of the petitioner is that no effective steps are being taken by the court of learned Additional District Judge, Budgam in connection with execution of the decree and on this ground, he is seeking transfer of the Execution Petition. The grievance of the petitioner can be redressed by extending appropriate directions to the learned Executive Court so that the decree sought to be executed is satisfied at the earliest. In view of the above, the petition is disposed of with a direction to Additional District Judge, Budgam to decide and dispose of the Execution Petition filed by the petitioner, keeping in view the directions handed down by the Supreme Court in the case titled Periyammal (dead) through Lrs and Ors vs. Rajamani and Anr (Civil Appeal No. 3640-3642 decided on 06.03.2025).
