This Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed for quashing the entire proceedings of Criminal Case No.58 of 2023, “State vs. Ajay Kumar and Others”, pending before the court of Judicial Magistrate, Didihat, District Pithoragarh under Sections 147, 323, 325, 504 and Section 506 of the Indian Penal Code, 1860. 2. Mr. Deep Prakash Bhatt, learned counsel for the applicants-accused. 3. Mr. Pradeep Lohani, learned Brief Holder for the respondent no.1. 1 2025:UHC:8400 4. Mr. Amit Kapri, learned counsel for the respondent nos.2 & 3. 5. All the applicants-accused are present through video conferencing. They are identified by Mr. Deep Prakash Bhatt, Advocate. 6. The respondent no.2/informant-injured and the respondent no.3, the injured are present through video conferencing. They are identified by Mr. Amit Kapri, Advocate. 7. The applicants, the respondent no.2 and the respondent no.3 submitted that there were private disputes between them and they have settled their all the disputes. Now, they are living peacefully and in harmony. They have filed a Compounding Application (IA No.1 of 2025) and affidavits with their free will and without any pressure. 8. The respondent no.2 and respondent no.3 have requested to quash the entire proceedings of Criminal Case No.58 of 2023. 9. The said request has not been opposed by the learned counsel for the respondent no.1. 10. In the facts and circumstances of the case, ends of justice would be met if the entire proceedings of Criminal Case No.58 of 2023, “State vs. Ajay Kumar 2 2025:UHC:8400 and Others”, pending before the court of Judicial Magistrate, Didihat, District Pithoragarh, are quashed. 11. Resultantly, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Criminal Case No.58 of 2023, “State vs. Ajay Kumar and Others”, pending before the court of Judicial Magistrate, Didihat, District Pithoragarh, are hereby quashed. ___________________ Date: 19.09.2025 ALOK KUMAR VERMA, J.
