Mr. Praveen Swarup, Counsel for the petitioner points out that the issue which was there before the Writ Court in W.P.(C) 11878/2016, as noted in order dated 20th January 2023, was about the equivalence of the diploma secured by the petitioner, from IME, Mumbai. 2. This issue was also evident from the order of the Central Administrative Tribunal (‘CAT’), where the eligibility of the petitioner’s application was rejected by the LDCE on the following grounds: 3. The respondent shall file a response in this regard, within the next 8 weeks, with copies to the counsel for the petitioner, specifically documenting as to why this issue was not raised at that point of time and why fresh speaking orders should not be passed in terms of the limited issue which was there before the CAT and before the Writ Court. 6.
