(2) Petitioner was awarded a contract by Executive Engineer, National Highway Division, PWD, Barkot, District Uttarkashi on 15.6.2023. According to petitioner, she completed the assigned work to the satisfaction of concerned authority, however payment of the work done by her has not been released. Thus feeling aggrieved, she has filed this writ petition seeking the following relief: “I. Issue a writ, order or direction in the nature of mandamus calling the record from the office of respondent no. 2 and directed to make payment of work in pursuance of the work order bond no. CB No. 39/AE-IV, dated 15.06.2023, with admissible interest expeditiously as possible within definite span of time (contained in Annexure no. 1 to the writ petition). (3) Learned State Counsel was asked to get instruction. Mr. Suyash Pant, learned State Counsel, on instruction, makes a statement that a sum of ₹7,27,626/- is payable to the petitioner, however the said amount could not be released so far for want of fund. He submits that State Government has been requested to provide necessary fund so that payment can be made. (4) In such view of the matter, writ petition is disposed of with liberty to the 2025:UHC:8585 petitioner to approach the Secretary, PWD by making a representation for release of amount. If she makes representation within two weeks from today, Secretary concerned shall look into the matter and pass necessary order within six weeks thereafter.
