This is an old Appeal pertaining to the year 2004 and, therefore, we have gone through the record of the Appeal. We find from the order-sheet that the Court had summoned the living status report with regard to the appellant Medai by its order dated 18.12.2022. The Chief Judicial Magistrate Hardoi, has sent a report dated 27.01.2023 wherein it has been stated that when bailable warrant was tried to be executed, Police Station- Pali has sent a report that the Appellant- Medai died two years ago. A copy of the report sent by the Police Station concerned and also the statement of the Gram Pradhan of the Gram Panchayat Nagla Khanpur, Development Block Shahbad, District Hardoi, has been enclosed with the said report. Since this Appeal has been filed by the sole appellant- Medai, who is said to have died some three years ago, the Appeal is dismissed as abated.
