According to him, District Development Officer issued a tentative seniority list and invited objections from all Village Development Officers; petitioner filed objection, but, without considering the same, seniority list was finalised. Thus, feeling aggrieved, petitioner has approached this Court seeking a direction to the Competent Authority to consider his objection against tentative seniority list, submitted on 25.05.2025. 4. Once seniority list is finalised, there is no question of considering any objection. 5. Rule 9 (4) of the Uttarakhand Government Servants Seniority Rules, 2025:UHC:8651 2002 reads as under:- “9(4) The appointing authority shall, after disposing of the objection by a reasoned order, issue a final seniority list.” 6. Since seniority list is finalised after considering competing claims of members of service, therefore, the appointing authority discharges quasi judicial function and in the absence of power of review available under the Rules, he cannot revisit the issue of seniority. Therefore, there cannot be any direction to the competent authority to re-visit the seniority merely because petitioner’s objection was not considered. Petitioner has the remedy to challenge final seniority list issued by the competent authority before the appropriate forum. 7. In such view of the matter, the writ petition is disposed of with liberty to petitioner to challenge the final seniority list before Public Service Tribunal.
