Mr. Jahangir Iqbal Ganai, learned senior counsel appearing for the petitioners, at the outset submits that the controversy involved for adjudication in this petition is fully covered by the judgment dated 30th August, 2025 passed by this Court in WP (C) No.416/2024 and connected matters and, therefore, this petition may be disposed of in terms of the aforesaid judgment. 2. Mr. Ilyas Nazir Laway, learned GA appearing for the respondents takes exception to the submissions made by the learned senior counsel for the petitioners and submits that the petitioners are fence-sitters and have filed this petition only after becoming wiser in view of the judgment passed by this Court dated 30th August, 2025 supra. 3. Having heard learned counsel for the parties and perused the material on record, we are of the considered opinion that the controversy raised in this petition by the petitioners is squarely covered by our judgment dated 30th August, 2025 passed by this Court in WP(C) No. 416/2024 and connected matters and, therefore, this petition deserves to be disposed of in terms of the aforesaid judgment. Ordered accordingly. 4. The judgment impugned dated 13.10.2023 is set aside. The case of the petitioners shall be considered in light of the judgment passed by this Court in WP(C) No. 416/2024 & connected matters.
