“....pleased to issue a Writ of Mandamus or any other appropriate writ, order or direction declaring the action of the 2""' Respondent in not passing orders on the representation dated 21.10.2019 of the petitioner for payment of subsistence allowance for the suspension period from 16.02.2010 to 31.05.2014 and Annual Grade Increments as illegal, improper, unjust, arbitrary and contrary to law and further direct the 2"^^ Respondent to
pass orders on the representation dated 21.10.2019 of the Petitioner and pass such other order or orders as the Honble court may deem fit and proper in the circumstances of the case and in the interests of justice....” The case of the petitioner in brief is that the petitioner worked as Village Revenue Officer(VRO) at Tarigonda Village of Gurramkonda Mandal and placed under suspension vide proceedings, dated 08.12.2009 alleging that he was involved in acts of forged PBs/PDs and failed to handover the village accounts/records of Peddamandyam Village.
Thereafter, the Charge Memo was issued by the 2^^^ respondent, dated 23.10.2010 and the enquiry officer submitted enquiry report. The petitioner submitted written representation to the 2'’'' respondent to that effect, but, without considering the same, the 2^"^ respondent has issued punishment orders vide proceedings
2. Roc.No.12657/2009, dated 19.05.2014 imposing a punishment of stoppage of 3 annual grade increments with cumulative effect. Basing on the orders passed in O.A filed by the petitioner, the 2^^^ respondent issued proceedings dated 17.06.2014 reinstating the petitioner into service and posted as Village Revenue Officer, Dandikuppam Cluster of Santhipuram Mandal in the existing vacancy. However, the petitioner did not join duty due to ill health and per posting orders. 06.10.2016 reported duty on as nd dated 30.09.2016. Thereafter, the petitioner made a representation to the 2 respondent dated 21.10.2019 requesting to release the half pay salary and 3 Annual Grade Increments etc.,. But till today no action has been taken by the 2"'^ respondent. Hence, the present Writ Petition is filed. 3. Heard Smt Y.Mahalakshmi,
learned counsel representing on behalf of Mr K.Ramamohan, learned counsel for the petitioner and the learned Government Pleader for Services-I appearing for the respondents. On hearing, learned counsel for the petitioner submits that though ; the petitioner has submitted representation, dated 21.10.2019 for payment of subsistence allowance for the suspension period from 16.02.2010 to 31.05.2014 and Annual Grade Increments, but the 2'’^' respondent has not considered the said representation which is illegal, arbitrary and violative of principles of natural justice. Hence, the learned counsel for the petitioner
4. requests to pass appropriate orders.
5. Whereas, learned Government Pleader for Services-I seeks time for filing counter affidavit. As there was already a conditional order granted by this Court on 27.11.2024 that no further time will be granted, the request of the learned Government Pleader is not considered and the right of filing counter affidavit by the respondents is forfeited. Considering the submissions of learned counsel for the petitioner and the learned counsel for the respondents, the 2"'* respondent is directed to consider the representation, dated 21.10.2019 submitted by the petitioner and
6. pass appropriate reasoned orders, in accordance with law, within a period of three (03) months from the date of receipt of a copy of this order.
7. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
