Accordingly, CAN 1 of 2025 is disposed of. WPA 4137 of 2025 A report has been submitted by the Inspector of police, O/C Keshpur police station where regarding the facts of the previous year, it has been recorded “Permission has been given to both the parties to organize religious rituals on the occasion of Radhakunja and Shibaratri…”. So far as the other issues are concerned, it is left open to the local administration to decide the same in consonance with the ground realities existing at the locality. The SDPO-in-charge of Keshpur police station will monitor and keep a track on the situation prevailing therein and pass necessary directions. Since a large number of villagers are involved, if they are able to carry out the religious rituals in a peaceful manner on the occasion of the aforesaid two festivals, unnecessary police interference may not be required. However, if the police authorities have any information that there may be law and order problem, it would be the absolute discretion of the police authorities to stop further act and/or activities and, in that case, religious rituals and/or fair whatever is over there at the behest of both the parties - be it the applicant and the petitioner - should be stopped by the police authorities. No single organization and/or any party should be allowed to carry out the religious rituals and/or other activities in aid of the religious rituals at the site. It is reiterated that the conditions, venue and the time schedule would be fixed by the police authorities as already the participation of the villagers are in process. With the aforesaid observations, WPA 4137 of 2025 is disposed of. Pending application(s), if any, is also disposed of. Report so submitted be kept with the record. Copies of the report be handed over to both the parties. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
