This Application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing the entire proceedings of Criminal Case No.915 of 2024, pending before the court of learned Additional Chief Judicial Magistrate, Khatima, District Udham Singh Nagar under Section 30 of the Arms Act, 1959. 2. Ramandeep Singh is the son of the present applicant. He (Ramandeep Singh) threatened the informant with the licensed pistol of his father on 09.11.2023. Ramandeep Singh was exonerated by the Investigating Officer during the investigation. 1 2025:UHC:8928 3. Mr. Vishwast Kandpal, learned counsel for the applicant. 4. Mr. Pratiroop Pandey, learned Assistant Government Advocate for the respondent nos.1 and 2. 5. Mr. Akshay Joshi, learned counsel for the respondent no.3 - informant. 6. The applicant – accused Ranjeet Singh is present in-person. He is identified by Mr. Vishwast Kandpal, Advocate. 7. The respondent no.3 is present in-person. He is identified by Mr. Akshay Joshi, Advocate. 8. Both, the applicant and the respondent no.3 submitted that they have filed a Compounding Application (IA No.1 of 2025) and affidavits with their free will and without any pressure. They are living happily and in harmony. The respondent no.3 has requested to quash the entire proceedings of Criminal Case No.915 of 2024. 9. Learned counsel for the State has opposed the request of the respondent no.3. However, he submitted that no evidence to this effect has been produced during the investigation that the informant was threatened by the son of the applicant with his (applicant) licensed pistol. 2 2025:UHC:8928 10. Considering the totality of the matter, this Court is of the view that ends of justice would be met if the entire proceedings of Criminal Case No.915 of 2024, pending before the court of learned Additional Chief Judicial Magistrate, Khatima, District Udham Singh Nagar, are quashed. 11. Resultantly, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Criminal Case No.915 of 2024, pending before the court of learned Additional Chief Judicial Magistrate, Khatima, District Udham Singh Nagar, are hereby quashed. ___________________ Date: 09.10.2025 ALOK KUMAR VERMA, J.
