Heard learned counsel for the applicant, learned AGA for the State and perused the record. The instant application under section 483 Cr.P.C. has been filed with the prayer for direction to learned Additional Sessions Judge/Special Judge, POCSO Act, District Gonda to decide the application under Section 257 of Cr.P.C., moved by opposite party no. 3 in Complaint Case No. 22 of 2023; Hari Narayan Vs. Umesh and others, under Sections 323, 506, 376D, 363, 366A IPC and Section 5G/6 of POCSO Act, Police Station Nawabganj, District Gonda, expeditiously. Learned counsel appearing for the applicant submits that the matter pertains to the year 2023, but even after passing of two years, the proceeding of the case has not been concluded as yet. After arguing at length, learned counsel appearing for the applicant submits that interest of justice would be sub-surved if this Hon'ble Court may be pleased to direct the trial court to decide the matter within the stipulated period of time as may be fixed by this court. Considering aforesaid innocuous prayer, the learned trial court concerned is directed to consider and decide the application under Section 257 of Cr.P.C., moved by opposite party no. 3 in Complaint Case No. 22 of 2023; Hari Narayan Vs. Umesh and others, under Versus Counsel for Applicant(s) : Awadhesh Kumar Tiwari Counsel for Opposite Party(s) : G.A. Vimal Jaiswal .....Applicant(s) State Of U.P. Thru. Addl. Chief Secy. Deptt.
