Order on Board 11/03/2025
1. The present criminal revision under Section 19(4) of the Family Court Act has been preferred by the applicant assailing the
order dated 30.01.2025 passed by the learned Family Court, Durg, Chhattisgarh, in Case No. 265/2023 whereby an appeal under Section 125 of CrPC filed by the applicant/wife and learned Court below has granted interim maintenance amount of Rs.1,500/- per month to the applicant/wife.

2. Facts of the case, in brief, is that earlier occasion, the applicant had filed an application u/s 125 of Cr.P.C. before the Family Court, Durg District - Durg and the same was in favour of the applicant and learned Family Court allowed the said application and granted maintenance of Rs. 15,00/- to the applicant/wife.
3. Learned counsel for the applicant submits that the learned Court below has fixed the monthly maintenance amount i.e. Rs. 15,00/- to the applicant which is a meager amount. He further submits that applicant is an unemployed lady who has not source of any income and is educated till class 10th only. He further submits that the non-applicant/husband earns a salary of Rs.1 Lakh per month from working as Principal at Government Higher Secondary School and has Agricultural land from which he earns additional income therefore, he prays for set aside the impugned order dated 30.01.2025.
4. I have heard learned counsel for the respondent and perused the records with utmost circumspection.
5. On perusal of records, it transpires the fact that the applicant had filed an application u/s 125 of Cr.P.C. before the Family Court, Durg and the same was allowed on 30.01.2025 and granted Rs. 15,00/- to the respondent. On account of inflation has increased a lot, considering the facts and circumstances of the case, and also considering the facts that the applicant/wife had to leave her matrimonial house and keeping in view the time elapsed and the increase in inflation after the said order 30.01.2025 because of which she is facing great hardships and
3 is unable to maintain herself, this Court is of the opinion that the learned Family Court has rightly passed the impugned order and enhanced the maintenance amount from Rs.1,500/- to Rs.5,000/- in which there is no need for interference.
6. Accordingly, this petition is partly allowed. Sd/-
