Petitioner was appointed as Chowkidar in Government Museum, Almora in the year 1985; he was promoted as Junior Assistant in the year 2009; thereafter he was promoted as Senior Assistant; and upon completing age of superannuation, he retired on 30.11.2022. 4. Learned counsel for petitioner submits that due to some personal problem, petitioner remained unauthorisedly absent from time to time and the period of his unauthorised absence is 2970 days, against which leave without pay was sanctioned to him for a period of 517 days, however, for the remaining period, no decision has been taken by the Competent Authority. He submits that because of inaction on the part of the authority in taking decision regarding regularising period of unauthorised absence, petitioner has not been paid pension and 2025:UHC:8656 other retiral dues, even though he retired on 30.11.2022. 5. Learned counsel for petitioner refers to certain representations, which petitioner made from time to time. 6. Having regard to the facts and circumstances of the case, the writ petition is disposed of with liberty to petitioner to make fresh representation. With the representation, petitioner may refer to the recommendatory letters, if any, issued in his favour. If petitioner makes representation within two weeks from today, the Director, Department of Culture (respondent no. 2) shall examine the issue and take decision, as per law, within three months thereafter. The competent authority shall also consider granting provisional pension to the petitioner in the meantime.
